To take care of family migrants, every country has a special visa category generally known as Family visa. Under this visa category candidates can migrate to Australia along with their families under various conditions and permanent citizens or eligible New Zealand invite their spouse, parents, children or relatives to join them in Canada.

The various categories under the family visa are:

Partner visa

The Partner visa offered by the Canadian immigration department is meant for individuals who are married or in a de facto relationship. The visa is granted if the applicant’s partner is an Australian citizen, a Permanent resident of Australia or eligible New Zealand citizen.

However, in order to migrate to Australia on the basis of marriage, the applicants need to meet certain criteria & guidelines set by the Immigration department.

Prospective Marriage Visa

The prospective marriage visa is meant for individuals who intent to visit Australia to marry their fianc. The prospective marriage visa is granted for a period of nine months, and the applicants have to marry their fianc within this time limit. After you are married, your partner can also apply for a partner visa.

Spouse visa

The spouse visa Australia allows spouse or de facto partners of the Australian permanent residents to live in Australia with their partners. In order to attain spouse visa for Australia, there are certain conditions that must be fulfilled. This visa allows the married partner or de facto partners of an Australian resident to move to Australia. Some of the eligibility conditions for married partners are:

UK Spouse Visa

The Spouse visa for United Kingdom is granted for a period of two years, after that you have to apply for Indefinite Leave to Remain and after the completion of third you can start the process to become a British citizen, this visa allows the spouse to stay in the United Kingdom and work there.

There are some eligibility criteria that must be met in order to get a spouse visa:

  1. You should be above the age of 18.
  2. You must have met and should be legally married.
  3. You must intend to live permanently as man and wife.
  4. You must have enough funds.

UK Unmarried Partner Visa

The defacto visa in UK is known as the Unmarried Partner Visa. It works in the same lines as the spouse visa. You will need a sponsor who is a permanent resident of UK. This visa is also valid for two years and there are no restrictions on working in the UK. The applicant for spouse visa must be above the age of 16 and the sponsor should be a permanent British national and above the age of 18.

Spouse Visa

If you are married to a Canadian citizen or a permanent resident legally then your spouse can sponsor you under the spouse visa category in Canada. If you got married outside Canada then your marriage must be recognized under the law of that county and under Canadian laws, in case you got married in an embassy than the law of the country where the embassy is located will be considered and not the country of the embassy.

In case, you were married in Canada than you have to produce the marriage certificate from the province or the territory where the marriage has taken place. The sponsored spouse must live then you must live together in a legitimate relation with the sponsor for a period of two years from the day you receive your permanent residency.

The processing time for this visa varies depending upon the region you come from, the processing time depending upon the region are follows:

  1. Africa and Middle East – 8 Months to 22 Months
  2. Asia and Pacific – 8 Months to 28 Months
  3. Europe – 8 Months to 15 Months
  4. Americas – 10 Months to 25 Months

Same Sex Spouse Visa
If you want to sponsor your same sex spouse then you must fulfill certain criteria:

1) If the marriage has taken place outside Canada than it will be considered valid only if the marriage considered legal under the laws of the country.

2) If the marriage took place in Canada, than a marriage certificate from the province or territory where the marriage took place must be produced.

Common Law Partner

To be eligible under this category you must be living together in a conjugal relationship for at least a period of twelve months and prove that you share a common household. To prove this you would need the following documents, residential lease agreement, joint bank accounts, mails etc.

Conjugal Partner Visa

This category is applicable to those couple who cannot qualify for either common law partners or spouse by living together.

If you are married to an Australian citizen, permanent resident or eligible New Zealand citizen, or have been in a De-facto relationship for at least 12 months, you may be eligible for immigration by obtaining a Spouse Visa to Australia. You can apply for permanent residence if the relationship is still genuine and continuing.
If you would like to immigrate to Australia under the spouse visa category, you must first be married to an Australian citizen or an Australian permanent resident or an eligible New Zealand citizen.

Eligibility to apply for a Spouse Visa:
In order to be eligible for a spouse visa to Australia, you must fulfill the following requirements:

  1. You and your spouse should have a commitment to a shared life as husband and life, whether or not you are legally married.
  2. Your relationship should be genuine and continuing.
  3. Both the individuals should live together and should not live separately on a permanent basis.
  4. Unless you are legally married, you must have been in a spousal relationship for the last 12 months.
  5. You both need to be aged 18 or over.

Spouse Visa applicants must be able to demonstrate that they are either married to an Australian in a marriage valid under Australian law or in a de-facto relationship with an Australian for at least 12 months prior to making application.

There is a 2 stage(temporary and permanent) application process for the spouse visa. An applicant should apply for both visas simultaneously using a single application form and paying one application fee.

The Spouse Visa may be applied from inside or outside Australia. If you are applying while you are in Australia, you must also hold a valid substantive visa which has no condition attached preventing you from applying in Australia.

Prospective Spouse (Fiance) Visa 

A 2 stage visa application applies to prospective marriage partners of Australian citizens or

permanent residents. Applicants can apply for the prospective marriage visa which if granted, will be valid for 9 months. The applicant must enter Australia, marry their sponsor and apply for a spouse visa during this period. If successful, a temporary visa is granted valid for two (2) years from date of application. At the end of this period the relationship is assessed and if it is found genuine and ongoing, the applicant is granted a spouse permanent residency visa.

To be eligible to apply for a Prospective Marriage (fiance) visa applicants must be able to provide evidence that they have personally met their Australian partner/sponsor and that they are engaged to be married to the Australian sponsor in Australia. Applicants must also demonstrate that after marriage they intend to live together in a genuine spousal relationship and will apply for the spouse visa in Australia within the visa period.
