When we talk about Australian Family Visas the Prospective Marriage Visa is the most common visa. This visa is entitled to those applicants, who wish to enter Australia to marry their fiancé. This visa can be obtained by the applicant for a period of nine months. The applicant must enter Australia with the mindset to marry his/her fiancé in the valid period f the visa i.e. nine months. Like other visas this visa has outlined eligibility criteria for obtaining the Australian Prospective Marriage Visa.

To be eligible for Prospective Marriage Visa, you should:

An Australian citizen; or

An Australian permanent resident; or

An eligible New Zealand citizen.

All Prospective Marriage visa applicants must be sponsored by their fiancé (e) who must be at least 18 years of age.

Prospective Marriage visa applicants are required to demonstrate that they:

personally know and have physically met their fiancé(e); and

are engaged to marry their fiancé(e); and

will marry their fiancé(e) within the visa validity period; and

intend to live in a genuine spousal relationship with their fiancé(e).

A Prospective Marriage visa must be applied for offshore and applicants are required to be outside of Australia at the time that the visa is granted.

All Australian visa applicants are required to satisfy health and character requirements.

Can work in Australia.

Can apply for a Partner visa in Australia after you marry your fiancé (e).

Can study, but you will not have access to government funding.

This Visa is for people who are married, engaged or in de facto relation with an Australian citizen, Australian Permanent Resident or eligible New Zealand Citizen and want to live with their partner in Australia.

The different types of family visa australia

The partner visa is further divided into different sections such as-
Married partner visa – In this subclass one of the partner should be a citizen or permanent resident of Australia. This is also known as the spouse visa. When one of the partners who is not a citizen or a permanent resident of Australia, can visit his/her spouse in Australia through partner visa. In this case the eligible partner must sponsor their spouse for the visa. The marriage should be legal and should also provide the mutual commitment. Married partner can also apply for Permanent residency visa after a span of 2 years.

De facto relationship – This visa is for those partners who have been in a relationship for over 1 year but are not married. The partners should be above 18 years. For the visa partners need to give prove of their relationship and the Australian citizen or PR must sponsor their partner to stay with them in Australia.

Prospective marriage visa– The prospective marriage visa is the visa which is granted to an individual who wish to marry their fiancé in Australia. This visa is granted for a period of 9 months, within which the visa holder must marry their fiancé who is either a citizen of Australia or permanent resident. After the marriage the partner can apply for partner visa.

Family visa for Australian students– Those foreign national students who have come to Australia for the intension of studying in a prestigious institution in Australia can bring one of their dependent family member or guardian with them. The family visa can be included in the student visa. This family visa also include dependent child and spouse who wish to accompany the student visa holder to Australia.

Parent Visa Australia – In this type of visa the child must sponsor his/ her parent and the child should be either a permanent resident or citizen of Australia. Even a New Zealand citizen is eligible to sponsor their parent for Australian parent visa.

These different types of family visa not only allow the parent and family members of Australian permanent resident or citizen to meet them but also strengthen the family bond.

If you are married to an Australian citizen, permanent resident or eligible New Zealand citizen, or have been in a De-facto relationship for at least 12 months, you may be eligible for immigration by obtaining a Spouse Visa to Australia. You can apply for permanent residence if the relationship is still genuine and continuing.
If you would like to immigrate to Australia under the spouse visa category, you must first be married to an Australian citizen or an Australian permanent resident or an eligible New Zealand citizen.

Eligibility to apply for a Spouse Visa:
In order to be eligible for a spouse visa to Australia, you must fulfill the following requirements:

  1. You and your spouse should have a commitment to a shared life as husband and life, whether or not you are legally married.
  2. Your relationship should be genuine and continuing.
  3. Both the individuals should live together and should not live separately on a permanent basis.
  4. Unless you are legally married, you must have been in a spousal relationship for the last 12 months.
  5. You both need to be aged 18 or over.

Spouse Visa applicants must be able to demonstrate that they are either married to an Australian in a marriage valid under Australian law or in a de-facto relationship with an Australian for at least 12 months prior to making application.

There is a 2 stage(temporary and permanent) application process for the spouse visa. An applicant should apply for both visas simultaneously using a single application form and paying one application fee.

The Spouse Visa may be applied from inside or outside Australia. If you are applying while you are in Australia, you must also hold a valid substantive visa which has no condition attached preventing you from applying in Australia.

Prospective Spouse (Fiance) Visa

permanent residents. Applicants can apply for the prospective marriage visa which if granted, will be valid for 9 months. The applicant must enter Australia, marry their sponsor and apply for a spouse visa during this period. If successful, a temporary visa is granted valid for two (2) years from date of application. At the end of this period the relationship is assessed and if it is found genuine and ongoing, the applicant is granted a spouse permanent residency visa.

To be eligible to apply for a Prospective Marriage (fiance) visa applicants must be able to provide evidence that they have personally met their Australian partner/sponsor and that they are engaged to be married to the Australian sponsor in Australia. Applicants must also demonstrate that after marriage they intend to live together in a genuine spousal relationship and will apply for the spouse visa in Australia within the visa period.
