Tier 2 (Intra-company Transfer) visa

The Tier 2 (Intra-company Transfer) visa allows individuals from outside the European Economic Area (EEA) and Switzerland to take up a role offered by their overseas employer Â in theirÂ UK branch office,Â either on a long-term basis or for frequent short visits. There are 4 sub-categories:

Long-term staff

This visa category allowsÂ established, skilled employees who areÂ being transferred to the UK branch of their organisation for more than 12 months to fill a post that cannot be filled by a new recruit from the resident workforce

Short-term staff

This category is meant forÂ established, skilled employees to be transferred to the UK branch of their organisation for 12 months or less to fill a post that cannot be filled by a new recruit from the resident workforce

Graduate trainee

This visaÂ allows the transfer of recent graduate employees to a UK branch of the same organisation, as part of a structured graduate training programme which clearly defines progression towards a managerial or specialist role

Skills transfer

Skills TransferÂ allows the transfer of new graduate employees to a UK branch of the same organisation to learn the skills and knowledge required to perform their job overseas, or to impart their specialist skills or knowledge to the UK workforce.

To be eligible for a Tier 2 (Intra-company Transfer) visa, you must have:

certificate of sponsorship reference number
an â€˜appropriateâ€™ salary
at least Â£945 in savings to support yourself

To be eligible for the Tier 2 (Intra Company transfer)Â you must visa service the position which the employer is seeking to fill must meet National Vocational Qualification (NVQ) level 3 or above. Furthermore, if the candidate is a member of a specific profession they may be required to be registered with the appropriate governing body.

For example, a doctor must be registered with the General Medical Council. In addition, a selected candidate must have a level of knowledge that is

The candidate must have one of the following:

A relevant degree
A non-relevant degree and one year of experience
No degree and three years of relevant experience

The employee for whom the ICT is being sought must have been employed by the overseas company for a period of six months or more prior to the application. Documentary evidence of this relationship must be produced before visas of this class can be issued.

A spouse/unmarried partner will be permitted to join an ICT holder on a dependency visa providing that they will cohabit with the holder of the Intra-Company Transfer visa.

In the case of an unmarried partner, they must be able to prove that the relationship has been in existence for at least two years prior to making the application for ICT.

Spouse immigration under this type of visa is granted as a temporary measure. Unlike a marriage visa or De Facto visa, commonly referred to as an Unmarried partner visa, ICT’s do not provide a route for you or your spouse to obtain settled status.
