H2B Visa USA for Foreign Workers

The H2B visa is another non-immigrant visa which is being granted to foreign workers seeking temporary or seasonal work in US. These jobs have to be non agricultural jobs and temporary. United states every year welcome foreign seasonal workers for managing the work load during the peak production times and others. This visa is provided through the state’s employment agency by a labor certification process. The visa validity period is of 1 year but can be extended by the employer by three years.

The H2B visa to issued to foreign nationals of Argentina, Australia, Barbados, Belize, Brazil, Bulgaria, Canada, Chile, Costa Rica, Croatia, Dominican Republic, Ecuador, El Salvador, Estonia, Ethiopia, Fiji, Guatemala, Haiti, Honduras, Hungary, Iceland, Ireland, Israel, Jamaica, Japan, Kiribati, Latvia, Lithuania, Macedonia, Mexico, Moldova, Montenegro, Nauru, Nicaragua, New Zealand, Norway, Papua New Guinea, Peru, The Philippines, Poland, Romania, Samoa, Serbia, Slovakia, Slovenia, Solomon Islands, South Africa, South Korea, Spain and Switzerland.

The employer employing a foreign worker must fill in the form I-129, which is a petition for Non-immigrant Worker, with the United States Bureau of Citizenship and Immigration Services (USCIS)
The applicant must fill DS-156, Application for Nonimmigrant Visa
If the applicant is male and between the age of 16 and 45 then, he must fill DS-157 application form
Must have copy of Notice of Approval of H-2B Petition
The applicant must meet the health and character requirements
The applicant should be national and hold passport of the eligible countries.

The spouse and children under the age of 21 can come along with the H2B visa holder but under the category visa of H4.
Children can study in US but cannot take employment without proper work permit visa.
